My wife lost control of the Outback and it started to fishtail and ended up on its roof. Both Wife and child are OK. The accident happened on Kyogle Rd UKI NSW. To add insult to our loss the Police are charging my wife with neglect, she was not speeding, not under the influence, so go figure I guess it is charge fee for service.

By 'neglect' do you mean 'negligent driving', as it is called in Victoria? I imagine this could have a negative impact on insurance pay-out, if found guilty.

I wonder if there would be any details on the vehicle computer that would assist in establishing that she was not speeding at the time.

Most of us have had a car 'fishtail' at some time. If it happens in circumstances where you can't take action to correct then it can be a bit tough. Even with AWD this is possible with soft / loose surface on sides of narrow roads. [If it wasn't a possibility, why the requirement for new vehicles to be fitted with ESD?]

With the absence of witnesses and no evidence of speeeding / alcohol, it would be worth getting character references from 'responsible' people who have known your wife well over the last few years, e.g. ministers of religion / employer / family friends who arelawyers or police, etc. Best of luck with it.

BTW, if the Subi is totalled, you might like to see if you can get the wheels back from the insurer. They are without doubt the best looking alloys Subaru have produced, and would grace any later model. They would also sell for a reasonable price on any of the subaru fora or e-bay to those wanting a matching spare.

It's the 'ol 5 Star safety rating that keeps our Blubaru as our primary family transportation vehicle.
 
Sorry to hear about this.

I got fined for Negligent driving after crashing a dirt bike in a national park. I took it to court and the fine was dropped.

Police policy is to charge for Neg driving with any accident especially when injury is involved.

Might be worth looking into - call the officer that issued the fine first; then decide if its worth fighting.

It has been almost two weeks since the accident, The wife has almost fully recovered from mild whiplash and the baby suffered no injuries to talk of and still looks forward to going for drives, Little people are so bullet proof. Still no news from the insurance company. The repair shop said it is a definite right off as the engine does not even turn over any more, apparently it hydraulic ed.
 
I have finally replaced the Outback after a long drawn out time, I decided on splitting the tasks I bought a new I30 slx cw auto for the missus and a 91 GQ patrol duel fuel for the hard stuff.
 
Good to hear you are back on the road Fabes.
The patrol should handle the towing real well.
Don't forget to keep hanging about on here.
